Welcome to LuminaFate ("Manifest Reality"). By accessing our website, web application, mobile applications, or any associated digital sanctuary services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue your use of the Service immediately.

1. Description of the Service

LuminaFate is an interactive, browser-based and native mobile sanctuary designed for meditation, mindfulness, focus, and sound exploration. The Service synthesizes real-time acoustic Solfeggio tones, binaural brainwave frequencies, and 3D sacred geometric projections locally on your device using client-side technologies.

2. Wellness & Audio Health Advisory

• Seizure & Photosensitivity Advisory: The Service includes audio-reactive oscillating visual patterns and rhythmic binaural frequencies. If you have a history of epilepsy, seizures, or photosensitivity, consult your healthcare physician before using the visualizer or binaural soundscapes.
• Situational Awareness: Never listen to LuminaFate frequencies or soundscapes while driving, operating heavy machinery, or engaging in any activity that demands your undivided attention.
• Hearing Protection: Always begin audio playback at a low, comfortable volume before gradually adjusting. Extended exposure to excessive volume levels can cause irreversible hearing damage.

3. Accounts & Authentication

Core features of LuminaFate can be experienced freely as a guest without creating an account. If you choose to sign in using Google, Apple, Facebook, or AOL/Yahoo, you are responsible for maintaining the security of your authentication credentials and for all activities that occur under your session.

4. Ascension Sanctuary Memberships & Access Keys

LuminaFate offers optional premium tiers ("Ascension Sanctuary", "Communion Pass", "Adept Access") that unlock elevated esoteric features and sound archives:

• Web Checkouts: Web purchases are processed securely through certified payment gateways (e.g., Stripe). Payment data is handled directly by the processor and is never stored on LuminaFate servers.
• Ascension Keys: Valid promotional or membership Ascension Keys provide non-transferable access associated with your account or device.
• Subscriptions: Subscriptions renew automatically at the specified billing interval (e.g. monthly) until cancelled by the user prior to the end of the current billing cycle.
• Refund Policy: All digital memberships, lifetime passes, and key redemptions are non-refundable once activated, except as required by applicable consumer protection laws or platform policies.

5. Intellectual Property Rights

All software code, visual engine shaders, 3D sacred geometry algorithms, custom sound synthesizer designs, branding, logos ("LuminaFate"), and alchemical iconography are the exclusive intellectual property of ChrisWorldwide and its licensors, protected by copyright, trademark, and international intellectual property laws. You may not copy, reverse-engineer, decompile, redistribute, or create derivative works from the Service without express written permission.

6. User Content & Audio Uploads

LuminaFate allows users to upload custom audio files for client-side decoding and real-time visualization. You represent and warrant that you own or possess the necessary rights and licenses for any audio file you load into the Service. Custom audio files are processed locally within your device's browser memory and are never uploaded to our servers.

7. AI Oracle & Hermetic Sage Disclaimers

The Hermetic Sage and AI Oracle features generate philosophical discourse and Hermetic maxims via cloud and local AI models. Responses are provided strictly for artistic, contemplative, and philosophical enjoyment. They should not be interpreted as financial, legal, psychological, or medical counsel.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LUMINA FATE, CHRISWORLDWIDE, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law provisions.
